13. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Elixir Lab is registered, without regard to conflict of law principles.

12. TERMINATION

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.

11. CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or via other reasonable means. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ELIXIR LAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

9. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. THIRD-PARTY SERVICES

8.1. The App integrates with third-party services including but not limited to:
- Google Sign-In and Apple Sign-In for authentication
- Google Play Billing and Apple StoreKit for payments
- Firebase for analytics and push notifications
- OpenAI for AI-powered lesson generation, chat, grammar, and dictionary features (with your explicit in-app consent before data is sent)
Speech-to-text and text-to-speech are operated on our own infrastructure and are not listed as third-party AI services above.
8.2. Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party service providers.

7. INTELLECTUAL PROPERTY

7.1. The App, including its design, code, graphics, and AI-generated lesson structures, is the property of Elixir Lab and is protected by intellectual property laws.
7.2. These Terms do not grant you any right to use our trademarks, logos, or brand elements without prior written consent.

6. AI-GENERATED CONTENT
AND DATA SHARING

6.1. The App uses artificial intelligence provided by OpenAI to generate lesson content, translations, conversational responses, grammar feedback, and dictionary explanations. Speech-to-text and text-to-speech are provided through our own hosted services and are not processed by OpenAI.
6.2. Before your messages or related learning context are sent to OpenAI, the App will ask for your explicit consent and explain what data is shared and with whom. By agreeing in the App, you authorize us to transmit that data to OpenAI for the purposes described in our Privacy Policy. You may withdraw consent in App settings.
6.3. AI-generated content is provided for educational purposes only. We do not guarantee the accuracy, completeness, or reliability of AI-generated responses.
6.4. AI-generated content does not constitute professional advice of any kind (linguistic, legal, medical, or otherwise).

5. USER CONTENT
AND CONDUCT

5.1. You retain ownership of any text, audio, or other content you submit through the App ("User Content").
5.2. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store such content solely for the purpose of providing and improving the Service.
5.3. You agree not to:
a) Use the App for any unlawful purpose;
b) Attempt to reverse engineer, decompile, or disassemble the App;
c) Interfere with or disrupt the App's servers or networks;
d) Use automated systems or bots to access the App;
e) Submit content that is abusive, harassing, or violates the rights of others;
f) Attempt to gain unauthorized access to other users' accounts.

4. SUBSCRIPTIONS
AND PAYMENTS

4.1. The App offers a free tier with limited functionality and a premium subscription ("Elixir Pro") that unlocks additional features.
4.2. Subscriptions are billed through the Apple App Store or Google Play Store, depending on your platform. Payment terms, billing cycles, and pricing are presented at the time of purchase.
4.3. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your device's App Store or Google Play settings.
4.4. Refunds are handled according to the policies of the Apple App Store or Google Play Store. We do not process refunds directly.
4.5. You may restore previous purchases at any time through the App's settings.

3. USER ACCOUNTS

3.1. To access the App, you must create an account using one of the supported authentication methods (Google Sign-In or Apple Sign-In).
3.2. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
3.3. You agree to provide accurate and complete information during registration and to keep your account information up to date.
3.4. We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms.

2. ELIGIBILITY

You must be at least 13 years of age to use the App. If you are under 18, you must have the consent of a parent or legal guardian. By using the App, you represent that you meet these requirements.
