Welcome to Elixir. Please read these Terms of Use (the "Terms") carefully before using the Elixir mobile application (the "App"), which is owned and operated by Elixir Lab ("we", "us", "our"). By downloading, installing or using the App you agree to be bound by these Terms. If you do not agree, please do not use the App.

Our Privacy Policy (https://elixirlab.io/privacy_policy) explains how we handle your personal data and forms part of these Terms.

1. SERVICE DESCRIPTION
Elixir is a mobile application for learning foreign languages with the help of artificial intelligence, available for iOS and Android devices. The App provides the following features:
  • a short spoken diagnostic at sign-up that builds your speech profile and sets your starting level;
  • a personalised weekly plan of lessons generated with artificial intelligence, each lesson consisting of a theory part and a roleplay practice conversation with an AI tutor;
  • lesson reports and weekly reports with your score, progress and areas to work on;
  • speech recognition (Speech-to-Text, STT) and speech synthesis (Text-to-Speech, TTS);
  • a personal dictionary for saving words and phrases with translations, pronunciation and examples;
  • push notifications and practice reminders;
  • an interface available in 30 languages;
  • access to extended features through a paid subscription (section 4).
We may add, change or remove features of the App at any time. Some features may be unavailable in certain regions or on certain devices.
2. ELIGIBILITY
You must be at least 13 years old to use the App. If you are under 18, you may use the App only with the consent of a parent or legal guardian. By using the App you confirm that you meet these requirements.
3. ACCOUNTS
3.1. To use the App you must create an account using one of the supported sign-in methods (Sign in with Google or Sign in with Apple).
3.2. You are responsible for keeping your account credentials secure and for all activity that occurs under your account.
3.3. You agree to provide accurate and up-to-date information when registering and to keep it updated as necessary.
3.4. We reserve the right to temporarily restrict access to your account or terminate it if we have reasonable grounds to believe that you have violated these Terms.
3.5. You may delete your account at any time in the App (Settings → Delete account) or by emailing social@elixirlab.io from the email address linked to your account. Account deletion is described in detail in section 6.3 of the Privacy Policy. Deleting your account does not cancel an active subscription; cancel it in the App Store or Google Play first (section 4.5).
4. SUBSCRIPTION AND PAYMENT
4.1. The App offers a free version with a limited set of features and a paid subscription, Elixir Premium, which unlocks the full weekly lesson plan, weekly reports and new plans every week, as well as other extended features shown in the App.
4.2. Elixir Premium is an auto-renewable subscription available in the following plans:
  • Monthly — billed every month;
  • Yearly — billed every 12 months.
The price for your region and currency, the billing period and the exact terms are shown in the App before you confirm the purchase.
4.3. Free trial. New subscribers may be offered a 3-day free trial. Payment is charged to your Apple ID or Google account at the end of the trial unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription. The free trial is available only once per user and may not be available for repeat subscribers.
4.4. Automatic renewal. The subscription renews automatically at the price shown in the App unless it is cancelled at least 24 hours before the end of the current billing period. Your account is charged for renewal within 24 hours before the end of the current period.
4.5. Managing and cancelling. Payment is processed by Apple App Store or Google Play Store depending on your platform. You can manage or cancel your subscription at any time in your App Store account settings (Settings → Apple ID → Subscriptions) or in Google Play (Payments & subscriptions → Subscriptions). Deleting the App or your account does not cancel the subscription. After cancellation you keep access to Premium until the end of the paid period.
4.6. Refunds. Refunds are handled in accordance with the rules of the Apple App Store or Google Play Store. We do not process refunds directly and cannot issue refunds for purchases made through the stores.
4.7. Restoring purchases. You can restore previously purchased subscriptions at any time in the App (Settings → Subscription → Restore purchases) when signed in with the same Apple ID or Google account that was used for the purchase.
4.8. Price changes. We may change subscription prices. Price changes take effect from the next billing period, and you will be notified in advance in accordance with App Store or Google Play rules. If you do not agree with the new price, you can cancel the subscription before it takes effect.
4.9. The App does not display third-party advertising.
5. USER CONTENT AND ACCEPTABLE USE
5.1. You retain ownership of any text, voice recordings and other content that you submit through the App ("User Content").
5.2. By submitting User Content you grant us a non-exclusive, worldwide, royalty-free licence to use, process and store it solely for the purpose of providing, maintaining and improving the App. Voice recordings are processed in real time for speech recognition and are not stored after processing, as described in the Privacy Policy.
5.3. When using the App you agree not to:
a) use the App for any unlawful purpose; b) attempt to decompile, modify, disassemble, reverse-engineer or otherwise obtain the source code of the App; c) interfere with or disrupt the servers, network infrastructure or other components of the App; d) use automated tools, scripts or bots to access the App, or use the App to build a competing product or to train machine-learning models; e) submit content that is abusive, unlawful, infringes the rights of others or is otherwise unacceptable, or attempt to make the AI tutor produce such content; f) attempt to gain unauthorised access to other users' accounts; g) share, resell or transfer your account or subscription to another person; h) circumvent subscription restrictions or payment.
6. ARTIFICIAL INTELLIGENCE AND DATA SHARING
6.1. The App uses OpenAI's artificial intelligence technology to:
  • generate learning materials and lesson plans;
  • produce translations;
  • generate the AI tutor's responses;
  • check grammar and evaluate your answers;
  • explain words and expressions.
Speech recognition (Speech-to-Text) and speech synthesis (Text-to-Speech) run on our own infrastructure and do not use OpenAI's services.
6.2. Before your messages or learning context are sent to OpenAI for the first time, the App will ask for your separate consent and explain:
  • what data will be sent;
  • to whom it is sent;
  • for what purposes it is used.
By tapping "I agree" you allow this data to be sent to OpenAI solely for the purposes described in our Privacy Policy. You can withdraw your consent at any time in the App's settings (Settings → Share data with OpenAI). While consent is withdrawn, AI-powered features, including chat lessons, are unavailable; the rest of the App keeps working.
6.3. AI-generated content is provided for educational purposes only. We do not guarantee that it is completely accurate, complete or free of errors. Lessons, corrections, translations, scores and level assessments are automated estimates and may contain mistakes.
6.4. Responses, recommendations and materials generated by artificial intelligence do not constitute professional advice of any kind, including:
  • linguistic;
  • legal;
  • medical;
  • or any other professional advice.
6.5. Roleplay conversations may involve fictional scenarios (for example, a visit to a doctor or a job interview). They are language exercises and must not be relied on as real-world guidance.
7. INTELLECTUAL PROPERTY
7.1. The App, including its:
  • design;
  • software code;
  • graphics and illustrations;
  • the structure of lessons created with artificial intelligence,
is the intellectual property of Elixir Lab and is protected by intellectual property law.
7.2. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for personal, non-commercial purposes.
7.3. These Terms do not grant you any rights to use our:
  • trademarks;
  • logos;
  • brand identity;
  • other brand elements,
without our prior written permission.
8. THIRD-PARTY SERVICES
8.1. Certain features of the App rely on third-party services, including but not limited to:
  • Sign in with Google and Sign in with Apple — for user authentication;
  • Google Play Billing and Apple StoreKit — for processing payments and managing subscriptions;
  • Firebase Cloud Messaging and Apple Push Notification service — for delivering push notifications;
  • AppMetrica — for usage analytics and crash reporting;
  • Meta Platforms (Meta SDK) — for measuring the effectiveness of our advertising campaigns;
  • OpenAI — for generating learning materials, AI tutor conversations, grammar checking, word analysis and the dictionary (only after your separate consent in the App before the first data transfer).
Speech recognition (STT) and speech synthesis (TTS) run on our own infrastructure and are not third-party AI services. How each of these services handles your data is described in the Privacy Policy.
8.2. Your use of third-party services is governed by their own terms of use and privacy policies. We are not responsible for the data-handling practices or actions of third-party service providers.
9. DISCLAIMER OF WARRANTIES
The App is provided "AS IS" and "AS AVAILABLE". We make no express or implied warranties, including but not limited to:
  • warranties of merchantability;
  • fitness for a particular purpose;
  • non-infringement.
We also do not warrant that:
  • the App will operate without interruption;
  • the App will be error-free;
  • the App will be free of harmful components;
  • any errors will be corrected in a timely manner;
  • you will achieve any particular learning outcome or language level.
10. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Elixir Lab shall not be liable for any:
  • indirect damages;
  • incidental damages;
  • special damages;
  • consequential damages;
  • punitive damages;
  • loss of profit;
  • loss of data;
  • loss of goodwill,
arising from the use of or inability to use the App.
To the maximum extent permitted by applicable law, our total liability for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid us for the subscription in the 12 months preceding the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer protection rights in your country of residence.
11. CHANGES TO THESE TERMS
We reserve the right to change these Terms at any time. If the changes are material, we will notify you through the App or by other reasonable means. By continuing to use the App after the changes take effect, you confirm your acceptance of the updated Terms.
12. TERMINATION
12.1. We may restrict, suspend or terminate your access to the App, in whole or in part, at any time without prior notice if:
  • you violate these Terms;
  • required by law;
  • there are other reasonable grounds.
Upon termination your right to use the App ends immediately. Termination does not entitle you to a refund of any subscription fees, except where required by applicable law or the rules of the App Store or Google Play.
12.2. You may stop using the App at any time by deleting your account (section 3.5) and uninstalling the App.
13. APPLE APP STORE ADDITIONAL TERMS
If you downloaded the App from the Apple App Store, the following also applies:
  • these Terms are concluded between you and Elixir Lab only, not with Apple. Apple is not responsible for the App or its content;
  • the licence granted to you is limited to a non-transferable licence to use the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions;
  • Apple has no obligation to provide maintenance or support for the App;
  • in the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App;
  • Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and consumer protection claims;
  • in the event of a third-party claim that the App infringes intellectual property rights, Elixir Lab, not Apple, is responsible for the investigation, defence, settlement and discharge of such claim;
  • you represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties;
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
14. GOVERNING LAW
These Terms are governed by and construed in accordance with the laws of the country in which Elixir Lab is registered, without regard to its conflict-of-law rules. If you are a consumer, you also benefit from any mandatory provisions of the law of the country in which you reside.
